Rules and Requirements

Members in the JPL program are required to comply with the DMCA statutory license agreement. Most of the applicable stipulations from the DMCA are summarized below.

  1. You may not routinely include in your Broadcast Programming sound recordings within one hour of a request by a listener or at a time specifically designated by the listener.
  2. In any three-hour period, you should not intentionally program more than three songs (and not more than two songs in a row) from the same recording.
  3. You should not intentionally program more than four songs (and not more than three songs in a row) from the same recording artist or anthology/box set.
  4. Continuous looped Broadcast Programming may not be less than three hours long.
  5. Broadcast Programs of less than one-hour may not be repeat performed more than three times in a two-week period.
  6. Broadcast Programs longer than one hour may not be repeat performed more than four times in any two-week period.
  7. You should not publish advance program guides or use other means to pre-announce when particular sound recordings will be played or the order in which they will be played.
  8. You should only include in your Broadcast Programming sound recordings that are authorized for performance in the United States.
  9. You should pass through (and not disable or remove) identification or technological protection information included in the sound recording (if any).

In addition, the following requirements apply:

  1. Broadcasts must be launched from the SWCast.net Website. Publishing direct links to stream servers or employing any other method to allow listeners to bypass the SWCast.net Website is prohibited.
  2. Broadcasts must transmit correct artist and track title data in the customary format for any music performed. Failure to supply this information is prohibited.

On July 11, 2005, exemptions pertaining to outside directory listings and direct launch links include

  1. Members may list their broadcast on the SHOUTcast or the AudioRealm directory so long as either software product is employed for purposes of broadcasting.
  2. Members may provide tune-in links for their broadcast on any Web page that is exclusive of SWCast.net but only through the use of GST protocol addresses.

Violation of the Personal Broadcast Services Agreement or the rules listed above, may result in account suspension or termination. Please contact legal for questions.
